1. Acceptance of Terms
By accessing or using OBSYNK (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Platform.
2. Platform Role
OBSYNK acts solely as a neutral platform and intermediary that enables creators to publish AI prompts, related media, and digital products, and enables users to discover, save, and purchase such content. We do not author, own, endorse, or guarantee any creator-submitted content.
3. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Platform. Verified Creator accounts require legal capacity to enter into contracts.
4. Account Security
You are responsible for all activity occurring under your credentials. Notify us immediately of unauthorized access. We may suspend accounts engaging in suspicious behavior.
5. User-Generated Content
You upload content at your own responsibility. You represent and warrant that you own or have the necessary rights, licenses and permissions to upload any prompt, text, image, or video. You retain ownership of your content; you grant OBSYNK a worldwide, non-exclusive, royalty-free license to host, display, promote, and distribute the content on and through the Platform for the purpose of operating, marketing, and improving the service.
6. Prohibited Content & Conduct
You may not upload or transmit content that is illegal, infringing, fraudulent, NSFW where prohibited, hateful, deceptive, exploitative of minors, or otherwise harmful. We reserve the right to remove any content and suspend or terminate accounts that violate these rules at our sole discretion.
7. AI Output Disclaimer
Outputs generated by AI models using prompts purchased on the Platform may vary based on the model, parameters, version, and external factors. We do not guarantee identical results to creator previews and are not liable for variations in AI outputs.
8. Payments, Pricing and Taxes
All transactions are processed in INR (or such currencies as we may support). Prices are inclusive of applicable taxes unless stated otherwise. You are responsible for any local taxes, levies, or duties resulting from your use of the Platform.
9. Subscriptions & Auto-renewal
Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
10. No Refunds
Except where required by law, all sales of digital products (including prompts, subscriptions, and verified creator memberships) are final and non-refundable.
11. Moderation Rights
We reserve the right (but assume no obligation) to monitor, review, edit, or remove content; restrict, suspend or terminate accounts; and decline service to anyone for any reason.
12. Intellectual Property of the Platform
The OBSYNK name, logo, trademarks, design system, software and aggregated data are owned by OBSYNK Labs. Nothing in these Terms transfers any platform IP to you.
13. Termination
We may suspend or terminate your access at any time, with or without notice, for any breach of these Terms. You may also delete your account at any time from settings.
14. Limitation of Liability
To the maximum extent permitted by law, OBSYNK and its affiliates shall not be liable for any indirect, incidental, consequential or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Platform.
15. Governing Law
These Terms are governed by the laws of India. Exclusive jurisdiction lies with the competent courts.
16. Changes
We may update these Terms from time to time. Material changes will be notified via email or in-app banner. Continued use of the Platform constitutes acceptance of the updated Terms.
